FIELD is an open-access, non-profit scholarly journal devoted to the independent critical analysis of socially engaged art practices. Our journal generates no revenue and is run entirely by volunteer labor. Any images that appear on our website are utilized strictly for non-commercial, academic commentary and critical analysis within the context of scholarly and artistic research. We maintain that our use of these images qualifies as Fair Use under 17 U.S. Code § 107, given the following factors:
• Purpose & Character: The images are used for educational, transformative, and non-profit critical analysis. The images documented specific events analyzed in the accompanying essays.
• Nature of the Work: The photographs are factual news assets rather than highly creative or fictional works.
• Market Effect: Because our journal is non-commercial and reaches a limited academic and artistic audience, our use has zero negative impact on the commercial market value or licensing potential of these images.
Despite this policy, as a gesture of good faith with image creators we still make every effort to ensure that the images we reproduce on our website don’t infringe on copyright protections of any kind.
